【失業保険】もし失業保険を受給している間に働いたら

もし失業保険を受給している間に働いたら・・・・
そんな質問を今日、お電話でいただきました。
下記がEDDで出ている回答です。

If I earn any wages while collecting unemployment insurance, how will that
affect my benefits?

Some unemployed workers may find opportunities for odd jobs, temporary work assignments, or part-time work while collecting Unemployment Insurance (UI) benefits. If you were not fully-employed during the week in which you worked,you may be able to receive reduced UI benefits even if your earnings are higher
than your weekly benefit amount as long as you meet all other eligibility criteria.

You must report any wages on your claim forms for the week in which you earned the wages, even if you weren’t paid for that work until later. Your gross wages are required (total without the payroll deductions) and the EDD will figure the amount of wages to deduct from your weekly benefit amount. A total of $25 or 25 percent of those earnings, whichever is higher, is not considered deductible from your benefits.

Any wages beyond that will be deducted from your weekly benefit amount and you will be paid the difference, if any. If you earn too much money in a week to receive any UI benefits, the UI benefits remain in your claim to collect at a later time during the benefit year of your claim as long as you remain unemployed and eligible.

If you accept full-time work for two weeks or longer, your claim will become inactive and no additional claim forms will be mailed. If you become unemployed again, you must submit a new application for benefits. The easiest way to do so is to submit your application online through EDD’s Web site at www.edd.ca.gov.

【ビザ】 今年はH-1Bビザにまだ余裕有り

2007年、2008年と申し込みが枠以上に殺到して、
くじ引きとなったH1-Bビザだが、今年は65,000の枠
に対して、42,000件の申し込みしかなかったようだ。

H1-BはGoogle、Microsoftのエンジニア(中国やインド出身
のヒトが多い)が多くを占めていたと言われているが
今年は不況で、IT系、自動車系のH1-B申し込みが激減した
のではないだろうか?

H1-Bで米国で仕事を探している人、H1-Bで人材を採用したい
企業にとっては朗報だ。

U.S. Citizenship and Immigration Services has received approximately 42,000 H-1B petitions counting toward the 65,000 cap for fiscal year 2010. The agency continues to accept petitions subject to the general cap.

【再告知】I-9フォーム変更は4/3から

明日4月3日よりI-9のフォームが変更になります。

I-9フォームは従業員を雇用する際に、労働許可があるか否かを確認する書類です。入社時に従業員に記入してもらい、個人ファイルに保存しておくことが求められます。

変更点は
・期限が切れた証明書類、パスポート等が無効になること
・LISTAにパスポートが追加になっていること
等があります。


Reminder: Form I-9 Changes Go Into Effect Tomorrow

On January 29, 2009, the United States Citizenship and Immigration Services (USCIS) issued an announcement that the required use of the new Form I-9, dated February 2, 2009, would be delayed until April 3, 2009. Starting tomorrow, April 3, 2009, the new form with a 2/2/09 revision date and June 30, 2009 expiration date will be required in place of the current form with the June 5, 2007 revision date and June 30, 2009 expiration date.

The Form I-9 is a required part of the hiring process for employers to verify that every new hire is either a U.S. citizen or authorized to work in the United States. Employers make this verification by examining documents noted on the I-9 form that establish identity and employment eligibility.

Changes to the form include:

* Expired documents are no longer acceptable, including U.S. Passports
* The Passport Card has been added as an acceptable List A document; and
* Form I-688, "Temporary Resident Card," and Forms I-688A and I-688B, "Employment Authorization Cards," are no longer issued and the agencies have determined that any such documents that were previously issued have expired. As such, these documents are removed from List A as acceptable documents.

【Exempt】不況下で自宅待機、Exemptの給料はどうすべきか?

不況下で自宅待機をせざるを得ない状況になっている企業も多いはずだ。しかし、FLSA (Fair Labor Standard Act)ではExemptの年間報酬を減額することはできないことになっている。
この点に関してDepartment of Laborからオピニオンレターが出ているので、読んでおきたい。端的に言えば、今まで取得したVacation, Paid Time Offから差し引くことができるという見解が出ている。
